Passion Fruit Girl Retrial 百香果女孩再审案

On October 4, 2018, Yang Moumou, a 10-year-old girl in Lingshan, Guangxi, died after being brutally raped by Yang Guangyi, a man from the same village, on her way home from selling passion fruit. The court of first instance sentenced Yang Guangyi to death for rape and deprived him of political rights for life.

In March 2020, the Higher People's Court of Guangxi Zhuang Autonomous Region revoked the first-instance judgment in the second instance, and sentenced Yang Guangyi to death with a two-year reprieve, deprived him of political rights for life, and restricted commutation of his sentence.

In May 2020, the Supreme People's Court decided to review the case of Yang Guangyi's rape case, which was the final trial of the second instance in the Higher People's Court of Guangxi Zhuang Autonomous Region. During the review period, the victim's mother filed a complaint. In November of the same year, the Supreme People's Court reviewed and decided to order the Higher People's Court of Guangxi Zhuang Autonomous Region to form a collegial panel to retry the case.

On December 28, 2020, the Higher People's Court of Guangxi Zhuang Autonomous Region issued a public verdict on the rape case of defendant Yang Guangyi in the original trial ordered by the Supreme People's Court to retrial: the original second-instance judgment was revoked, Yang Guangyi was sentenced to death, deprived of political rights for life, and reported to the Supreme People's Court in accordance with the law approved.

2018年10月4日，广西灵山10岁女童杨某某卖百香果回家途中，被同村男子杨光毅使用残忍的暴力手段强奸后死亡。一审法院以强奸罪判处杨光毅死刑，剥夺政治权利终身。

2020年3月，广西壮族自治区高级人民法院二审撤销一审判决，改判杨光毅死刑，缓期两年执行，剥夺政治权利终身，并对其限制减刑。

2020年5月，最高人民法院经研究决定，对广西壮族自治区高级人民法院二审终审的杨光毅强奸一案调卷审查。调卷审查期间，被害人母亲提出申诉。同年11月，最高人民法院审查决定，指令广西壮族自治区高级人民法院另行组成合议庭对该案进行再审。

2020年12月28日，广西壮族自治区高级人民法院对最高人民法院指令再审的原审被告人杨光毅强奸案进行公开宣判：撤销原二审判决，改判杨光毅死刑，剥夺政治权利终身，并依法报请最高人民法院核准。
