近代以来,晚清和民国的历史,就是被列强从军事和政治层面卡脖子的历史,说起来都是屈辱和眼泪。共和国之后,超级大国美苏也试图从军事和政治层面卡中国脖子,都被破解。如今再也没有任何国家可以从军事和政治层面卡中国脖子。这是巨大的历史进步。然而特朗普上任以来掀起的中美博弈,已经从贸易战扩展到科技战。

中国企业是怎么被美国卡脖子的

现在,我们尝试理解一下中国企业是怎么被美国卡脖子的。简单来说就是中国企业的产品中的某个创新完全依赖美国企业的技术,且没有替代方案,当有一天美国通过某种手段让中国企业无法再使用这一技术后,中国企业的产品就无法再生产。


主要可以使用的卡脖子手段主要包含切断供应链、专利封锁以及生态圈封锁

为了方便大家理解上述三种方式,我们基于企业产品与创新的关系图制定一些假设前提:大部分情况下,创新都可以产出专利,因此我们假设每个节点都有专利保护。节点中不同的颜色代表创新专利的知识产权归属,我们假设绿色是企业A的,黄色代表企业B的,红色代表企业C的,并且企业C是美国企业。


(1)切断供应链
切断供应链很好理解,就是让你买不到必要的模块。例如美国政府一纸令下将企业A列入实体清单,代表着企业C向企业A的出售模块4将受到美国政府管制。缺了模块4,如果企业A暂时找不到替代技术,产品的开发就有可能停摆。

(2)专利封锁
一个模块是由很多的创新叠加起来的,同行企业可能都在针对某个模块进行创新,因此一个模块很可能包含来自不同企业的专利。专利可以以侵权的名义主张侵权企业的产品在某个地区禁售,所以也有可能成为卡脖子的手段。

比如企业A开发的模块1中存在企业C的专利技术,企业C是可以向法院申请赔偿,甚至是在某个区域禁售相关产品的。当然,这也是一把双刃剑,假设企业C也在自己开发的产品中用到模块1,企业A也可以反过来告他。

所以专利战场上总能看到一些“蚂蚁战大象”的景象,这是因为一方面小企业没有产品,大企业没法反制,另一方面大企业收益高,小企业告大企业胜诉后可以获得丰厚的回报。

(3)生态圈封锁
生态的本质是大多数人在某个平台上日积月累形成习惯的结果。比如说微软的windows操作系统经过几十年的深耕,已经让全球的应用开发者形成了使用习惯,windows上也汇聚了大量的应用。硬件上安装操作系统,操作系统上安装应用,而应用又汇聚用户。用户习惯了使用windows系统,那么硬件和应用就成为了windows系统的从属。

生态圈封锁是指通过限制平台的上游或下游企业,来实现对企业的卡脖子。假设有一天微软宣布禁止在windows上安装某个应用,基本就宣告了这个应用的消亡,又或者有一天微软宣布不再预装在联想笔记本上,相信会对联想的销量造成很大的影响。因为用户可能不太会为了一个应用或者某个牌子的笔记本,而放弃已经形成习惯的办公用的office。

生态圈很容易形成马太效应,随着时间的推移,用户数越来越多,用户黏性越来越高。美国有一堆强大的生态圈,操作系统尤甚,除了微软的windows操作系统、还有谷歌的安卓操作系统、苹果的IOS操作系统。

因此,生态圈封锁是最具杀伤力的卡脖子手段,因为这是一个真正靠时间蓄力的大招,而不是瞬间的“尤里卡时刻”,已经超出了简单的创新部分。


解决“卡脖子”难题的有效工具

当前,我国各行各业所面临的“卡脖子”难题依然有待解决。我们都知道,“关键核心技术是要不来、买不来、讨不来的。”因此自主创新发展技术尤为重要。从政策端,可以从层层加码的支持政策看见国家对于“卡脖子”技术的重视。

在2022年的政府工作报告中出现了“专精特新”这一新词。报告提出要着力培育“专精特新”企业,在资金、人才、孵化平台搭建等方面给予大力支持。“专精特新”这一领域受到关注,就是因为“专精特新”在很大程度上是解决“卡脖子”问题的有效工具。通过关注细分领域并在这些领域获得竞争优势,甚至拥有话语权,能有效解决产业链的“堵点”,在“卡脖子”背景下建立中国的技术优势。

扶持举措上,2021年9月成立的北交所,核心目标之一就是成为“有效服务专精特新中小企业的资本市场专业化发展平台”。

2022年,我国计划在原有基础上,再培育3000家左右的国家级“专精特新”中小企业,带动培育省级“专精特新”中小企业由现在的4万多家增长到5万家左右。

除了各类“专精特新”中小企业,各行各业都出台了不少政策支持行业突破“卡脖子”技术。

中国科学院院长白春礼此前表示,要将“卡脖子”的问题和国外出口管制的清单转化为自己的任务清单。集中专家精英,在关键技术领域取得重大突破,从而逐步破解技术封锁,有利于掌握科技和经济发展的主动权。

在大众最关注的集成电路领域,国家先后发布了《重点新材料首批次应用示范指导目录(2019版)》、《国务院关于印发进一步鼓励软件产业和集成电路产业发展若干政策的通知》等支持性政策。目前也有不少成果:去年2月国防科技大学计算机学院QUANTA团队,联合军事科学院、中山大学等国内外单位,研发出一款新型可编程硅基光量子计算芯片,实现了多种图论问题的量子算法求解,有望未来在大数据处理等领域获得应用。

在光学机械领域,上海光机所疫情期间项目组封闭攻关,成功利用大口径离轴反射曝光系统制作米级脉冲压缩光栅,核心是利用2个大口径高精度的离轴抛物面反射镜形成两束平行光大范围构造均匀的曝光光场。其中,尺寸需要达到1.6m×1.05m(双向米级,对角线接近2米)的脉冲压缩光栅是系统的关键器件,也是支撑装置确保实现国际领先水平仍然存在的“卡脖子”技术之一。目前,国内外现有的光栅制备技术上包括机械刻划、细光束扫描拼接曝光、透射静态干涉场曝光等现有技术都达不到制备如此双向米级大尺寸光栅能力。同时,上海光机所项目组团队经过1年多的努力攻关,发明了极窄边缘效应一体式柔性研抛技术与装备、无轨迹波纹非正交磁流变抛光技术、计算机全息位相板检测、大镜低应力支撑等系列创新技术。

此外,稀土金属靶材作为溅射薄膜材料,广泛应用于5G通讯、交通运输等多个领域,但很长时间里,这种产品及应用在我国一直处于空白。有研科技集团的研发人员耗时1年多,经历了30多次试验,突破了铸造、变形、后处理、绑定等技术,成功开发多规格平面靶材、大尺寸旋转靶,其绝对纯度达到4N级水平,打破了国外技术垄断,大幅提高了我国靶材的核心竞争力。

中国企业如何突破卡脖子技术

现在回到我们最初提出的问题,“中国企业应该如何突破被美国卡脖子的技术”,我们之前分析了各种卡脖子的手段,当然就得针对这些手段有的放矢。

(1)人才是核心
人是创新的本源,也是公司创新的源泉。随着时间的推移,企业可能会倒闭,但是人不会因为企业倒闭而消失,而是在行业中流动。

在行业中深耕多年的创新者是这个行业的宝贵财富。从创新的公式来看,他们有着行业中最广泛最新的信息,同时他们经过多年的创新工作已经对“尤里卡时刻”非常熟悉,他们是这个行业的“卖油翁”。

因此,企业应该广泛吸纳懂得卡脖子技术的“卖油翁”。通过大量吸纳“卖油翁”,可以使企业快速积累起卡脖子模块的有用信息,并快速解决“切断供应链”的卡脖子手段。

有了大量信息的积累后,很有可能“尤里卡时刻”就在某个时刻光临了这个幸运的团队中的一员,帮助企业找到绕过这个模块专利的另一条技术路径,那就解决了“专利封锁”的卡脖子手段。

甚至,企业可能因为团队一员的“尤里卡时刻”演进出下一代技术,也就不难创造短时间赶超的奇迹了。

(2)关注高价值专利
每个模块都有多条技术路径,专利只是阻碍了其中一条路径,企业可以选择备选技术路径绕过专利封锁。但是,最终用到产品中的技术路径往往是权衡下来最优的方法。所以换条技术路径其实也是有风险的,面对“专利封锁”,最稳妥的方法就是把技术路径上的高价值专利买过来。

我们要明白专利的价值并不在于数量,而是在于质量。理想中的高价值专利是模块中必选实现的专利,也就是说任何公司生产这个模块,都必须按照专利来实现,很难找到替代方案。能获得这样一个专利抵得上成千上万的无关专利。因此企业只需要识别并获得这样一件专利,就能对卡脖子形成反制,毕竟大家都在同一个模块上有专利武器了,这样可以形成微妙的制衡关系。

(3)另起炉灶
最棘手的就是“生态圈封锁”,既然被一个圈子抛弃了,那就只能另起炉灶,自建另一个圈子了。正所谓“只有魔法才能击败魔法”,这个靠时间蓄积的大招也只能依靠时间去消减。

但是,有没有什么方法可以让这个时间加快呢?这个时候就需要打开以弱胜强的经典《毛选》了,毛主席说过“任何过程如果有多数矛盾存在的话,其中必定有一种是主要的,起着领导的、决定的作用,其他则处于次要和服从的地位。因此,研究任何过程,如果是存在着两个以上矛盾的复杂过程的话,就要用全力找出它的主要矛盾。捉住了这个主要矛盾,一切问题就迎刃而解了。”

也就是说我们要找到当前生态圈的主要矛盾,然后在新圈子中解决这一主要矛盾。举个例子,安卓系统由开源的基础框架代码和闭源的谷歌移动应用服务(简称GMS,包括谷歌邮箱、地图、钱包等)构成。手机厂商想用GMS都需要向安卓付费每台手机0.75美元的授权费,能不能只用基础框架代码而不用GMS呢,可以,但不好用,因为谷歌会逐渐在开源系统中停止应用的更新,而只在GMS里发布更新版本。由此可见,安卓系统的主要矛盾就是手机厂商与谷歌因紧耦合的系统收费的矛盾。所以,另起的炉灶需要重点解决这一矛盾。

与此同时,我们看到越来越多看过世界的国人最终回到了中国企业,高端人才已经就位;我们也看到5G、新能源、碳中和等新赛道上中国企业开始领跑,他人专利不再掣肘;我们还看到了鸿蒙、欧拉等中国生态开始挑战权威,星星之火可以燎原。加油!中国企业!
